Wollert Rise Deposit Back Promise (‘Promotion’)
Promotion Details
1. In these terms and conditions and any marketing materials and advertisements relating to the Promotion, ‘Dahua Group’ refers to Dahua Group Melbourne Number 6 Pty Ltd (ACN 615 975 347) or Dahua Group Melbourne Number 6 Pty Ltd (ACN 615 975 347) (as the context requires).
2. The Promotion runs from 12 May 2020 until 30 November 2020 (‘Promotion Period’).
3. The Promotion applies to all lots offered for sale by the Dahua Group in its proposed development at Wollert Rise during the Promotion Period (‘Eligible Lots’).
4. The Promotion is only valid for Eligible Participants (as defined below) during the Promotion Period, and is correct as at the time of publication, but may change at Dahua Group’s absolute discretion at any time.
5. Dahua Group reserves the right to refuse to offer the Promotion to particular purchasers at its discretion including where a purchaser is not currently employed, holds casual employment or that works in an industry that Dahua Group considers high risk. A purchaser will not have any rights against Dahua Group if it refuses to offer a purchaser with the benefit of the Promotion.
Eligibility
6. The Vendor may at its discretion consent to releasing the Purchaser under its contract for an Eligible Lot if:
a. Dahua Group and the purchaser of an Eligible Lot agree that the Promotion is available to the purchaser and enter into a deed that is validly signed and outlines the conditions of the Promotion at the same time that the purchaser signs the contract for the Eligible Lot; and
b. the purchaser satisfies all the conditions in the deed outlining the terms of the Promotion that is entered into by Dahua Group and the purchaser to Dahua Group’s absolute satisfaction (‘Eligible Participant’).
7. The Dahua Group reserves the right to make changes to the deed outlining the terms of the Promotion from time to time at its discretion.
8. The Promotion is personal to the purchaser that enters into a contract for an Eligible Lot. Purchasers acknowledge that any nominee under a contract for an Eligible Lot will not be eligible to be an Eligible Participant for the purposes of the Promotion.
Exclusions
9. The following parties are excluded from being deemed Eligible Participants for the purposes of the Promotion:
a. the Dahua Group determines at its discretion that a Purchaser should not be offered the Promotion; or
b. purchasers that do not sign a deed with the Dahua Group confirming that Dahua Group agrees to offer the Promotion to the individual purchaser; or
c. purchasers that resign or quit from their employment; or
d. purchasers that work part time or are engaged in casual employment as at the date that the contract for the Eligible Lot is entered into; or
e. any nominees that are nominated under a contract for an Eligible Lot; or
f. purchasers that have previously entered into a contract to purchase a lot at Wollert Rise; or
g. directors of Dahua Group’s partner builders or Dahua Group’s partner builders themselves; or
h. any other person or persons that are excluded pursuant to the terms of the deed that is entered into by Dahua Group and the purchaser.
10. In the event of any dispute as to eligibility for the Promotion, including a decision by Dahua Group to offer the Promotion to an Eligible Purchaser who may not otherwise be eligible for the Promotion, eligibility will be determined by Dahua Group and Dahua Group’s decision will be final and binding.
11. Dahua Group gives no warranty and makes no representation as to the accuracy or sufficiency of any description, illustration, photograph or statement contained in any advertisement, or any information or statements made or given by its employees, agents or contractors, and will not be liable for any loss or damage suffered or incurred by any party that relies upon the information in any advertisement, publication or statement except for any liability that cannot be excluded by law.
General Terms of the Promotion
12. Dahua Group will not be liable for any loss or damage suffered or incurred by any person who relies upon the information in any advertisement relating to the Promotion or participates in the Promotion except for any liability which cannot be excluded by law, nor for any restriction of Dahua Group’s ability to provide any aspect of the Promotion as a result of the act of any third party, its employees or agents.
13. Dahua Group may cancel or make changes to the Promotion at any time without notice. Such changes may include adding or withdrawing Eligible Lot, changing the criteria for Eligible Purchaser or shortening or extending the Promotion Period.
14. These terms and conditions supersede any prior terms and conditions for the Promotion.
Privacy
15. Dahua Group collects personal information in order to conduct the Promotion, to assist in providing the products or services an individual has requested (if any), and to improve its products and services. Googong Township may use the information for promotional, marketing, publicity, research and profiling purposes, and may be in touch by any means (including telephone, email or SMS) at any time to let an individual know about products, services or promotional activities which may be of interest until the individual informs Dahua Group otherwise.
16. Dahua Group may also share individuals information with other persons or entities who assist it in providing its products or services or running competitions or trade promotions. Dahua Group may also disclose personal information to third parties as required by Australian regulatory authorities.
17. Dahua Group is bound by the National Privacy Principles in the Privacy Act 1988 (Cth), and by participating in the Promotion, each individual is taken to consent to Dahua Group’s privacy policy.
